Allison Roberts, a mother residing in Portland, Oregon, has filed a federal lawsuit against Portland Public Schools and Meriwether Lewis Elementary School. The legal action, initiated on Wednesday, claims that Roberts experienced punitive measures after expressing dissent regarding the school's gender curriculum.
Background of the Dispute
The lawsuit, submitted by the Liberty Justice Center on Roberts' behalf, details her initial concerns from last year. These concerns arose when Meriwether Lewis Elementary School opted to update its traditional rainbow pride flag to an "Intersex-Inclusive Progress" variant. This new design, according to the legal filing, was intended to incorporate support for racial and transgender ideologies.
While Roberts expressed support for being immersed in Portland's gay community, she perceived the updated flag as "an overtly political symbol that promotes values contradictory to her Christian faith," particularly due to its endorsement of transgender concepts.
Prior to taking further action, Roberts became aware of an "identity flower" assignment given to her 11-year-old child. This assignment reportedly instructed students to identify and discuss their own gender identity with their peers and educators.
Roberts asserts she was not given advance notification about this specific assignment. She subsequently requested a meeting with the school's principal to address her concerns. After describing the school's response as unsatisfactory, Roberts composed an open letter to the community, criticizing the school's policies. She distributed this letter on a public sidewalk adjacent to school grounds.
School's Response and Trespass Order
Following a contentious interaction with another parent, Roberts was subsequently issued a one-year trespass order. This order prohibited her from attending various school activities, including her child's graduation ceremony. When she sought clarification from the school, Roberts was reportedly informed that the order stemmed from her engagement in "harassment, intimidation, and threatening behavior," which was characterized as part of a pattern of "animus and harassment targeting vulnerable members of [the] community."
Legal Challenge and Objectives
The Liberty Justice Center contends that the school's actions infringed upon Roberts' First Amendment and Fourteenth Amendment rights. The legal group argues that the school suppressed her speech and retaliated against her for criticizing its policies. The lawsuit seeks a federal court ruling declaring the school's conduct unconstitutional and an injunction to prevent the enforcement of policies that target Roberts.
Statements from Parties Involved
"Our next step in the case will be filing a motion for a preliminary injunction to put a stop to these unconstitutional policies while the case moves forward. This motion will help protect not only Allison’s rights, but all affected families in Portland."
A representative from the Liberty Justice Center stated.
"It has been heartening to see the outpouring of support from my local Portland community, and from parents and grandparents across the country. I never wanted things to get to this point. But knowing that I'm fighting this battle not just for my family, but for millions of American families, reassures me that bringing this suit is the right thing to do."
Roberts shared her perspective.
