Senator Fetterman Cautions Against 'Constitutional Crisis' as NYC Council Member Vows to Disregard SCOTUS Immigration Ruling

Senator John Fetterman, a Democrat representing Pennsylvania, issued a warning Saturday about a potential "constitutional crisis." His remarks came as some members of his own party appeared to overlook New York City Council Member Zohran Mamdani's declaration to disregard a Supreme Court decision that upheld the authority of former President Donald Trump to terminate Temporary Protected Status (TPS) for migrants from Haiti and Syria.

During a recent television appearance, Senator Fetterman recalled prior instances where Democrats had raised alarms about a "constitutional crisis" during the Trump presidency. He described his efforts at the time to alleviate those fears by pointing out that the Trump administration had not, in fact, defied court rulings.

"I haven't seen the freak-out now that the [Council Member] of New York is now saying I'm going to defy the Supreme Court ruling," he stated. "Many of the members in my party are not calling him out... [or they are] defend[ing] him, or just say[ing] we really actually have to follow the court rulings because… that's a constitutional crisis, when you have the leader of the country's largest city [saying] we're not going to follow or honor what the Supreme Court says."

Recent Supreme Court Immigration Decisions

Fetterman's comments followed two significant immigration-related legal victories for the former president last week at the nation's highest court. Both rulings were connected to his administration's initiatives to reduce asylum claims.

In the first case, Mullin v. Al Otro Lado, the Supreme Court determined that migrants who are turned away at the border before entering the United States are not eligible to apply for asylum.

In the second case, Mullin v. Doe, the court ruled that Haitian and Syrian nationals residing in the United States under Temporary Protected Status (TPS) could not obtain judicial relief to postpone the revocation of their status while they challenged the Trump administration’s efforts to end it in court.

These combined decisions provide the former Trump administration with new avenues to restrict asylum claims at the border and greater flexibility to proceed with ending temporary protections for certain migrants already within the country.

In a video statement concerning the Mullin v. Doe ruling, Council Member Mamdani asserted that the decision was something his administration "will never accept."

Broader Concerns About the Democratic Party's Direction

Senator Fetterman has consistently voiced concerns regarding far-left politicians, such as Council Member Mamdani, who appear to be gaining influence within the Democratic Party.

Other figures, including Maine Senate candidate Graham Planter, Los Angeles mayoral candidate Nithya Raman, Washington, D.C. mayoral candidate Janeese Lewis George, and several progressive candidates in New York City, have ignited broader discussions about the Democratic Party's perceived shift further to the left.
